Terms and Conditions
Unless otherwise agreed in writing, the companies current Terms of Business shall prevail over any conditions stipulated by the buyer and in the placing of an order with us, you are agreeing to accept these terms and conditions. Customers should therefore check, when placing an order, they are in possession of our current up to date Terms of Business.
All orders are to be paid for by Credit/Debit Card before goods are despatched.
DESCRIPTION OF GOODS
All sizes, weights, colours or any specifications given in our catalogue, or price list, are approximate and may vary from the published details.
PACKING AND DELIVERY – INLAND
All our published prices exclude packing and delivery. If special despatch cartons/cases/crates/pallets are required these are charged extra. Goods will be sent by normal inland carriage or post at our options. Where goods are required by overnight or other special carrier the extra cost will be added to the invoice. For Northern Ireland, Channel Islands, Scottish Highlands & Islands, and other U.K. destinations Involving sea or air freight the extra cost will be added to the invoice.
All goods that either qualify for free delivery, or pay £6.95, will be sent on a next day courier service. All goods that incur a postage cost of under £6.95, where a postage charge is applicable, will be sent out via Royal Mail standard post.
PACKING AND DELIVERY – EXPORT
All our prices exclude Packing and Delivery. Prices available on request. Please register on the website to obtain prices for UK mainland.
Orders for non-stock items, once accepted cannot be cancelled without our written agreement and payment of cancellation fee.
RETURN OF GOODS
Customers purchasing goods who find them unsuitable may return them at their own risk and expense within 14 days of original purchase. Full credit excluding postage costs will be given providing that they are received back by us, with receipt of purchase, in first-class condition in their original sales packaging. Any such returns must be agreed by us in advance. All Bingo machines come with a return to base warranty for 12 months, meaning any return must be done so at the customers own expense. Any costs will not be refunded. The customer can either return the machine to ourselves, or we can supply the manufacturers details for the machine to be sent direct, meaning a quicker repair of the goods.
Due to unsettled market conditions we can only accept orders on the basis that the goods will be charged at prices ruling on the date of despatch. For quantities other than shown, please ask for price.
All published prices are exclusive of Valued Added Tax.
PAYMENT OF ACCOUNTS
All credit accounts are due for payment by 20th day of the following month from the date goods were despatched or services provided. Credit Account customers who exceed our payment terms will have their account put on hold until payment in full is received. Overdue accounts are subject to a surcharge of 2% per month. Late payers will have their credit limits reviewed.
For those customers who do not have credit accounts, payment is required in full prior to collection or despatch of goods. For certain items, particularly those wrlch are being specially manufactured, a deposit will be required before placing the order.
OPENING AN ACCOUNT
Clubs and Organisations wishing to open an account are required to complete and sign our application form and to supply two trade references and complete our bank application reference form. Subject to satisfactory replies being received we will advise the limit of credit we are able to allow. we would be pleased to review your credit limit from time to time based on purchases and payment record.
OWNERSHIP OF GOODS
The seller retains the title to all goods supplied to the buyer until all have been paid in full. In case of default by the customer the company may (whether with or without previous notice) itself take repossession of the goods and the Company is in such circumstances irrevocable authorised by the Customer to enter any of the customers premises for the purpose of removing goods. If not withstanding that the property in and ownership of the goods has not passed to the customer, the customer shall deal with the goods in such a manner as to pass to a third party a valid title to the goods, the customer shall hold the proceeds of such sale on trust for the Company. the responsibility for any loss or injury after the date of consignment prior to the property in the goods passing to the customer is accepted by the customer as Bailee.
REPAIRS / STORAGE OF GOODS
Repairs are carried out and goods are stored entirely at customers risk. No liability can be accepted for goods lost or damaged in transit or in our possession. Goods renovated and not collected within 3 months of work being carried out are liable to be sold to defray costs.
GOODS LOST OR DAMAGED IN TRANSIT
All goods are at buyers risk as soon as they have been delivered or collected. Once the goods have left our premises our liability is limited to the carriers terms and conditions of transportation unless prior insurance has been arranged. Advice of despatch will be given by mailing an invoice or a delivery notice to the customer. If goods fail to arrive within a reasonable period of time – (maximum 7 days for UK sales and goods sent by air, maximum 14 days for europe and 28 days for rest of the World) then the seller must be alerted immediately by the telephone and also by fax or letter so that steps can be taken to trace the consignment. When goods arrive they should be signed for “unexamined” and must be inspected carefully and damaged/faulty or missing goods reported within two working days. The Company can accept no responsibility thereafter. All outer packaging must be kept for inspection. It is the responsibility of the Assured to claim immediately on the carriers and to comply with the insurance claim procedures.
DELIVERY / DESPATCH DATES
We will always endeavour to meet our customers delivery requirements and any delivery I despatch dates are given in all good faith, but we cannot be held responsible for delayed delivery / despatch howsoever caused.
CARRYING OF GOODS
If or when a customer provides assistance in carrying of goods or parts they do so on the understanding that it is entirely at their own or employers own risk.
We reserve the right to change or cancel any offers at any time without prior notice.
PULL TAB LOTTERY TICKETS
All Pull tab lottery tickets are sold under the agreement that they are either sold by hand, or if used in a lottery ticket vending machine, the owner of the machine has given the customer permission to use the tickets in their machine. Crystal & Son Ltd take no responsibility for any misuse of the tickets or any vending machines.
